Stephanie Lenz's YouTube video of her tot dancing to an old Prince song was pulled down at the request of Universal last year after the music label said that the clip infringed on its copyright. Not content with simply having Universal retract its claim, Lenz and the Electronic Frontier Foundation are out to put the squeeze on Universal for issuing a bad-faith DMCA takedown. But Universal told a judge this week that, even though the clip may in fact be "fair use," it was still "infringement" and therefore the initial takedown notice was made in good faith.

I'm sorry Universal, but Fair Use means it was legal. You admitting that it was fair use means you have dug your own grave on this one. Universal can't be punished retroactively because it turned out to be Fair Use, but there is enough case law surrounding Fair Use that it should have been obvious in the first place. Courts cannot be allowed to turn into playgrounds for deep pocket bullies to force potential Fair Use legalities out before they are ruled upon.

As much as I love to bash Windows in general, SanDisk seems to jump on the bandwagon when it serves its own purpose. They say that Windows Vista isn't optimized for solid state drives which is probably true. But they go on to say that this is causing a huge delay to work around the problems that Vista presents. That's the BS part. Provide the hardware, let the software maker work it into their system. This is another reason that shows the Linux method works better. Hell, the BSD side of things are working just as well. The Mac supports SSD with ease.

That is the gist of what is happening now that a load of major ISPs have signed a Message of Understanding with the National Center for Missing and Exploited Children (a private company). The MOU gives NCMEC the supreme authority to judge whatever website it wants to be taken down AND have the person's name and address forwarded to them for prosecution. We live in very troubling times when this sort of thing happens.

And don't bring the argument that we need to "think of the children." When a private corporation can censor what a country sees, what's to stop them for censoring a political party or other things that many people want to see (porn)?

This kind of corporate behavior is completely un-American and the NCMEC and the ISPs that signed this 'agreement' should be charged with sedition. Ohh, did you know that the NCMEC doesn't want their name to be included when a site is taken down?

Did you also know that there is no oversight. If the NCMEC says to take down a site, that's it.

The show brought many interesting products and one of such products are motherboards for AMD processors based on NVIDIA's new chipsets that feature an integrated graphics processor. Motherboards with integrated processor is nothing new to the computer world but NVIDIA's latest implementation is something new which they brand as HybridSLI. NVIDIA is planning to implement this feature in all of their future chipsets and we have seen motherboards with such feature with nForce 780a chipset. NVIDIA has just released two new chipsets, nForce 750a and GeForce 8300, which also features HybridSLI. I'm sorry, but news sources such as CNET have really lost credibility when they post crap like this. The article compares service update system's uptime on the internet from Apple, Canonical (Ubuntu's maintainer), and Microsoft. Basically it is taking pings from a site like Windows Update and comparing which update service has better uptime.

Fine, it's a stupid metric, but whatever. Where the crap starts to spread is the title of the article: "Microsoft ahead of Apple, Ubuntu in OS update reliability." Right of the bat, it looks like Microsoft's updates are more reliable than the other two providers. So if you glance the title and not the meat (as most IT managers do since they are lazy), you take that Microsoft provides better support... That's the first point.

They picked Canonical's mirror to judge this really useless statistic.

If you just glance over the article, you will see that Microsoft wins, hands down! CNET has really gone downhill recently. These "news stores" look more like paid posts. Even the comments on that story are saying the same thing. Sorry CNET, you keep losing credibility.

As if we didn't see this coming..... I can appreciate that Apple will continue to provide useful quality content for the iPhone. The iPhone App Store will be included in the updated version of iTunes. Just another example of an amazing execution off of a business model that has proven to work flawlessly. Did I mention that 25% of the applications are alleged to be free?!

This could be the beginning of something good. But, it's a bit strange to me that Best Buy will sell a free product for $19.95. I was looking for details to see if it came with a book or something to make the price reasonable. However, the description of the product isn't very good. This could be helpful in getting the name out there to the non-enthusiast market. Think you paid too much for your Playstation 3? Don't expect any sympathy from Sony.
In the company's fiscal 2008 annual report, Sony revealed that they've now lost roughly $3.3 billion (that's billion with a B) on the Playstation 3 since its launch. That breaks down to $2.16 billion in 2007, followed by a notably smaller but equally daunting $1.16 billion loss in 2008.

For comparison purposes only, really. Unlike Microsoft, who has nothing to really show for their losses with the Xbox 360; I doubt Sony shareholders are worried too much about it as Sony's Blu-Ray gamble paid off. It does show that Sony managed to halve their operating losses within a year while Microsoft is seemingly having more trouble doing so (in addition to losing far more money), though the over a billion put aside for the warranty extension and repair program probably didn't help Microsoft meet their goal.

This move will really stop the Vista rollout in its tracks. When Microsoft said that the next version of windows will be released in less than two years, you know it has a problem. Vista is a failure. Windows 7 will be just as bad. It will be pushed back, and continue to stop people from adopting Vista. The Linux Foundation is going on a rant and complaining about Nvidia's binary only drivers. Nvidia is the only large graphics company to not attempt to open up their specifications on the hardware. Intel, VIA, and even AMD have opened up their hardware. Linux is the future and if Nvidia continues this trend, AMD is in a good position to clean up. I have in my hands a Sapphire Radeon HD 4850 that works well in Linux and was just released.

"Vendors that provide closed-source kernel modules force their customers to give up key Linux advantages or choose new vendors." But Bottomley gets much more specific than this. "Their (Nvidia's) binary module is one of the top causes of kernel crashes, which makes Linux look bad," he said. "Nvidia does a reasonable job of Q-and-A-ing (quality assurance) of a certain number of configurations but the problem is that their configurations (are) a lot less than what's actually out there on the market," Bottomley said.

That being said, AMD's fully open source driver team at Novell still as a ways to go before being on par with the FireGL binary driver. Even so, AMD is providing more and more feature with FireGL including Crossfire support (finally!).
